What Our Initial Consultation Covers

The estate planning process starts with a free, initial 45-minute consultation. At the beginning of the consultation, we will spend time obtaining information from the potential client about their family situation, and general financial information.

This information is necessary to ensure that we create a complete estate plan for our clients.

A careful analysis of the estate tax and how it might affect the potential client is made. The estate tax is a tax that the Internal Revenue Service assesses on the transfer of ownership of assets when someone passes away. It can be levied on real estate, stocks, bonds, bank accounts, retirement plans — anything of value. Tax laws are in a constant state of flux, and it is important to work with a lawyer to ensure you are protected to the maximum extent possible.

What Role Does Your Family Play?

As a potential client, it is extremely important to plan your estate. Particular attention should be paid to the plan of distribution. For some of our potential clients, the plan of distribution is quite simple. They leave all of their assets to their children in equal shares. For some of our clients, however, it is not always that simple. It is at this point, that we learn about your complicated family situation including second marriages, daughters-in-law and sons-in-law. Additionally, the plan of distribution can be quite complex for our clients with disabled children or grandchildren. The only people that benefit from a proper estate plan are our clients and their families. It is especially important for potential clients with these complicated family issues to set up a proper estate plan.

Another important discussion at the initial consultation deals with issues related to incapacity. Properly drafted trusts and powers of attorney can facilitate your loved one's handling of your financial and health care matters in the event you become incapacitated.

At the end of the consultation, we give the potential client a quote on what we charge to implement the suggested estate plan. At that point, it is up to the client to decide if they want to proceed.
