Congress passed the American Taxpayer Relief Act of 2012 making the estate tax permanent. It is now possible to transfer $5 million during life or at death, and this amount is adjusted for inflation. In 2017, the estate tax is $5.49 million per person or $10.98 million for married couples. The maximum tax rate also increased from 35% to 40% for individuals passing more than $5.49 million.
